| Abstract | Urban development is one of the important directions for the development of a modern state. In order to ensure the proper functioning of this area, it is necessary that the relevant governmental authorities monitor the observance of legislation in the field of urban development, project documentation, building codes, state standards and rules. The purpose of the article – to review the historical development of architectural and construction control in 1917–1991. The problems that arise in the scientific interpretation of the concept of “control”, whose fuzzy nature actually negates the legal nature of control, creating a conceptual confusion, which reduces the effectiveness of regulatory regulation of social relations, which complicates the mechanism of public administration. There were analyzed the issues of the gradual development of the Institute of Architectural Supervision in Construction Activity from 1917 to 1991; considered documents that are of fundamental importance in the field of architectural supervision in construction; analyzed the structure and legal basis of functioning of architectural supervision in construction activity. It has been determined that during the Soviet period in Ukraine rigid construction planning, monopoly state distribution of building materials and a rather complicated procedure for obtaining a permit for construction and land acquisition were formed. This indicates that state control during this period acquired the feature of the departmental, that is, exercised by those ministries and agencies in whose interests the construction was conducted. It was made a conclusion that the bodies of supervisory activity in building area have a special status, their right to cover measures of state coercion is guaranteed by the state. Most violations of construction law are classified as misdemeanors, and therefore the measures of administrative and legal influence have been imputed to the violators. |
